Private practice agreements and special purpose funds
Throughout Australia, public hospitals are identifying problems in relation to the private practice agreements and supporting arrangements for their senior medical staff. Over the years, these have developed in an organic way and may no longer be compliant with the various regulations governing private practice in public hospitals. Specialist outpatient clinics accessing MBS funding and inpatient billing arrangements create risks for both the hospital and its medical staff, if not properly structured. Senior Medical Staff Contracts
Many hospital managers inherit a series of idiosyncratic senior medical staff contracts, special deals and side agreements, which have been negotiated between previous management and senior medical staff.

These arrangements are often difficult to administer, with inconsistencies between them and modern industrial agreements. It can be unclear which entitlements prevail. They can also create difficult precedents when engaging new staff.

Rationalising these agreements requires sensitivity and an understanding of why they were created in the past, combined with an ability to work with doctors to understand the mutual benefits of normalising these arrangements.
